D. J. McCarthy, Superintendent of the California Men's Colony at San Luis Obispo appeals from an order granting Charles Denton Watson's petition for a writ of habeas corpus seeking, pursuant to section 2900.5 of the Penal Code,*fn1 285 days presentence credit for jail time spent in custody in Texas. The central question which we face is whether petitioner is entitled to have such time credited upon his sentence where it was spent in jail in a foreign jurisdiction while he was resisting extradition to California for trial upon charges of which he was ultimately convicted. As will appear, we conclude that he is entitled to the credit. We affirm the order.
